Acceptance of terms
By submitting a listing, placing a bid, completing checkout, or using BidPeak, you agree to these Terms, the Rules, the Privacy Policy, and the Refund Policy.
If you do not agree, do not submit a listing, place a bid, or continue using the service.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use BidPeak. By using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Open participation
BidPeak does not require an account. Anyone may submit an eligible destination, place the first bid on a free listing, or increase an existing paid bid.
A listing does not establish ownership, endorsement, affiliation, or authorization by the destination's owner. BidPeak may correct, suspend, or remove listings when necessary.
Listing submissions
You must provide accurate, lawful, and non-deceptive information. Submitted destinations and content must comply with the Rules and may be inspected, normalized, or rejected automatically.
You may not submit malware, phishing, scams, impersonation, illegal services, prohibited content, unsafe downloads, or destinations intended to evade validation.
Free and paid placement
Eligible sites may be published without payment. Paid listings always rank above free listings. Paid listings are ordered by active bid; free listings are ordered by recent qualified activity.
Ranks are dynamic. A competitor may place or increase a bid at any time, including while another checkout is open.
What a payment purchases
A completed payment activates or increases a listing's public bid. The bid determines a changing position among paid listings across worldwide, category, and country scopes.
A payment does not purchase ownership of a listing or destination and does not reserve a permanent rank.
Payments, refunds, and disputes
Checkout is provided by a third-party payment provider identified during checkout, which processes buyer payment and billing information under its own terms and privacy policy.
Only server-verified payments affect rank. Refund eligibility is governed by the Refund Policy and rights or actions available through the original provider. Disputes, reversals, or chargebacks may suspend the affected listing.
Intellectual property
BidPeak and its original content, features, functionality, and design are owned by Nexofts Ltd (trading as BidPeak) and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service without written permission.
No performance guarantee
BidPeak does not guarantee traffic, qualified clicks, leads, sales, revenue, search visibility, availability, or any other business result.
The service and its rankings are provided on an as-available basis and may change as listings, bids, safety decisions, or technical conditions change.
Limitation of liability
To the maximum extent permitted by law, Nexofts Ltd and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
Our total liability to you for any claim arising from or related to these Terms or the service shall not exceed the amount you paid to BidPeak in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Nexofts Ltd (trading as BidPeak) and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or fees (including reasonable legal fees) arising from your violation of these Terms or your use of the service.
Suspension and service changes
BidPeak may reject, correct, suspend, or remove a listing for safety, legal, payment, abuse, or policy reasons. Access may be limited when necessary to protect the service or its users.
These Terms and the service may be updated prospectively. Material revisions will be published on this page with a revised effective date.
Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
